Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FreightTruth platform at freighttruth.com, operated by FreightTruth ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our platform.

Service Description

FreightTruth is a predictive intelligence platform for trucking fleets. Our platform provides:

  • Trip simulation — route planning with truck-optimized routing and Hours of Service (HOS) compliance forecasting
  • HOS forecasting — forward-looking estimates of driver available hours based on FMCSA regulations
  • Load feasibility analysis — evaluation of whether a driver can complete a load within regulatory limits
  • Telematics integration — connection to fleet telematics providers for real-time operational data
  • Fleet analytics — operational intelligence including facility dwell time analysis and detention prediction

Features may be added, modified, or removed as the platform evolves.

Early Access Program

FreightTruth is currently in an early access phase. By participating in our early access program, you acknowledge and agree that:

  • The platform is under active development and may contain bugs, errors, or incomplete features
  • Features, functionality, and availability may change without prior notice
  • Service interruptions may occur for maintenance, updates, or unforeseen issues
  • We may collect feedback and usage data to improve the platform
  • Early access does not guarantee continued free access once the platform reaches general availability

We appreciate your participation and feedback during this stage.

Account and Access

Eligibility

FreightTruth is designed for commercial trucking fleet operations. By using our service, you represent that you are at least 18 years old and have the authority to agree to these Terms on behalf of yourself or the organization you represent.

Your Responsibilities

You agree to:

  • Provide accurate and complete information when registering or using the platform
  • Keep your access credentials secure and confidential
  • Notify us promptly of any unauthorized use of your account
  • Use the platform only for lawful purposes related to fleet operations
  • Comply with all applicable laws and regulations

Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to our systems, other user accounts, or data
  • Interfere with or disrupt the platform, servers, or connected networks
  • Reverse engineer, decompile, or disassemble any part of the platform
  • Use automated tools (bots, scrapers, crawlers) to access the platform without our prior written consent
  • Reproduce, distribute, or create derivative works from our content without authorization
  • Misrepresent your identity or affiliation with any person or organization
  • Use the platform to transmit malware, viruses, or other harmful code

Simulation and Data Accuracy

Disclaimer

The trip simulations, HOS forecasts, and analytical outputs provided by FreightTruth are estimates and predictions based on available data, routing algorithms, and regulatory models. They are intended to assist operational decision-making but are not a substitute for professional judgment.

Specifically:

  • Route estimates may differ from actual road conditions, traffic, weather, or construction
  • HOS projections are based on FMCSA regulatory models and may not account for all real-world variables
  • Facility dwell time predictions are based on historical patterns and may not reflect current conditions
  • Load feasibility scores are advisory and should not be the sole basis for dispatch decisions

You are solely responsible for ensuring compliance with all applicable laws, regulations, and safety requirements, including but not limited to FMCSA Hours of Service regulations.

Intellectual Property

Our Content

The FreightTruth platform, including its design, code, content, features, algorithms, trademarks, and documentation, is owned by FreightTruth and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our content without our prior written consent.

Your Data

You retain ownership of the data you provide to FreightTruth. By using our platform, you grant us a limited, non-exclusive license to use, process, and store your data as necessary to provide and improve our services.

You may request export or deletion of your data at any time by contacting us at info@freighttruth.com.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • FreightTruth is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory
  • We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
  • Our total liability for any claims arising from these Terms or your use of the platform shall not exceed the amount you paid to FreightTruth in the twelve (12) months preceding the claim, or $100, whichever is greater

Indemnification

You agree to indemnify and hold harmless FreightTruth and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the platform
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any operational decisions made based on platform outputs

Termination

We may suspend or terminate your access to FreightTruth at any time, with or without cause, and with or without notice. You may stop using the platform at any time.

Upon termination:

  • Your right to access the platform ceases immediately
  • We may delete your account data after a reasonable retention period
  • Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) will remain in effect

Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Effective Date" above.

Your continued use of FreightTruth after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, please discontinue use of the platform.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms will be resolved in the applicable courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
